What is wrongful termination?

Wrongful termination is an illegal firing.  In many wrongful termination cases, the firing is illegal because it violates a specific law.  For example, firing an employee because of color, national origin, race, religion, or sex violates Title VII of the Civil Rights Act.  It is also illegal for the government to retaliate by firing you because you complained about your supervisor’s unlawful conduct.  If that happens, you may have a claim for wrongful termination.


Employees may be able to sue for wrongful termination in other situations, too.  Termination may also be wrongful if it violates a specific public policy.  For example, there are laws that give employees the right to file claims for worker’s compensation benefits.  An employee could bring a claim for wrongful termination if her employer fires her because she filed a claim for worker’s compensation.

What are my rights?
