What is the Family and Medical Leave Act (FMLA)?

The Family and Medical Leave Act (FMLA) is a federal law that provides job protections to certain employees who need to take leave for medical reasons.  Eligible employees may use FMLA leave for their own illness, to care for a loved one who is sick, or for the birth or adoption of a child.

What are my rights?

The FMLA covers only certain employers, including private-sector employers with more than 50 employees. You may be eligible for FMLA leave if you have worked for a covered employer for at least 12 months and if you worked at least 1,250 hours during the previous 12-month period.


Eligible employees may take up to 12 weeks of unpaid leave for medical reasons.  This means that your employer can’t fire you while you are on FMLA leave.  The FMLA also prohibits employers from retaliating against employees for taking or requesting leave.


Many states have their own laws that provide additional protections to employees who need to take medical leave.
