We represented a Department of Navy employee who received a proposed removal for Unacceptable Performance following alleged unsuccessful completion of their PIP. We argued that the Agency was holding the employee to an unreasonably high standard of performance and that the employee had met the PIP requirements. Based on our arguments, the Deciding Official reversed the proposal and held that our client did perform at an acceptable level during the PIP and returned the employee to their position.
