DoD rescinded proposed removal based on Douglas factors

Our client received a proposed removal for alleged misconduct.  Colleagues were not removed or suspended for similar misconduct.  The written response and oral reply we provided pointed out several inconsistencies in the agency’s reasoning and documentation.  We also argued that the agency failed to consider mitigating factors, including our client’s successful performance record during his 25-year federal career.  Based on our arguments and evidence, the agency rescinded the proposed removal.
