Case SUMMARY

DoD reinstated security clearance after hearing

The U.S. Department of Defense (DoD) proposed to revoke our client’s security clearance based on charges of security violations and personal conduct.  The client retained us to represent her at an administrative hearing before the Defense Office of Hearings and Appeals (DOHA).  At the hearing, we presented evidence that our client did not engage in any security violations.  We also argued that, even if there were violations, so much time had passed since the incident that there were no outstanding concerns.  In addition, we presented testimony from friends, family, supervisors, and coworkers to establish our client’s impeccable character.  The judge agreed with our arguments and evidence, specifically noting the supervisor’s testimony regarding our client’s excellent work ethic, and reinstated the client’s security clearance.
