Complainant v. Department of the Army, EEOC No. 531-2021-00187X

We represented an Army employee in a case involving national origin discrimination and harassment.  Our client had a good performance record and positive relationships with management until he was assigned to a new first-line supervisor.  The new supervisor assumed our client was Hispanic and made discriminatory comments, such as telling him to “go back to the border” and referring to him as “Mexican” in a pejorative way.  He also created memes depicting President Trump telling the client to “report to the border.”  Ultimately, the supervisor became aggressive and threatened to “shove a PVC pipe” in the client’s rectum, a threat that was corroborated by a witness.  Army ultimately agreed to participate in mediation and settle with our client.
