What is the DC Office of Employee Appeals?

District government employees may appeal certain personnel actions, including suspensions, demotions, and terminations, to the Office of Employee Appeals (OEA). Administrative Judges (AJs) within the OEA will make a decision about whether your suspension, demotion, or termination was wrongful.

 What are my rights?

If you are a District employee and you were wrongfully demoted, suspended, or terminated, you have rights. Within 30 days of the adverse action, you must file an appeal with the OEA. The OEA will serve a copy of the petition for appeal on the agency, who will file a response. The case will then be assigned to an Administrative Judge for a hearing and decision. If a hearing is held, each party will present evidence and have an opportunity to cross-examine witnesses. The Administrative Judge will consider all evidence presented at the hearing and issue an Initial Decision.

 

An unfavorable Initial Decision can be appealed to the OEA Board or to the DC Superior Court. If you appeal your decision to the Board, a panel of judges will decide whether the Initial Decision should be reversed.

 

At any time before a decision, the parties can request mediation. If this happens, the appeal is referred to the OEA Mediation and Conciliation Program and a mediator is assigned to handle the case. If the case does not settle at mediation, the OEA resumes processing of the appeal.
