Our clients are two research assistants working for the Department of Veterans Affairs. For years, their supervisor sexually harassed them by touching them inappropriately and kissing them on the lips. Due to fear of retaliation, our clients did not immediately report the supervisor to the EEO office. By the time they did, the agency dismissed their cases for untimely EEO contact. We appealed the dismissal to the Office of Federal Operations and argued that even if the physical touching had ended, as long as they were under the supervision of the supervisor, the harassment continued. The OFO agreed and ordered the agency to investigate their claims.
