Medicaid Fraud Qui Tam Lawsuit Unsealed by Federal Judge

Some years back, Mark Razin was an employee of Healthcare Financial Advisors Inc. ("HFA"), a company that worked with hospitals on patient-related cost reports. A central goal of the services provided by HFA to its clients was to obtain for them the highest possible dollar amounts on Medicare reimbursements.

To accomplish that aim, HFA encouraged its hospital clients to reopen accounts from prior years. HFA then made upward "adjustments" that were passed on to Medicare for payment. The practice resulted in an appreciable income stream for the hospitals and high profits for HFA.

There was only one problem with the adjustments: They were fraudulent, and the hospitals knew it. Razin dutifully informed the government of that fact by becoming a qui tam whistleblower, and a lawsuit was brought against Christus Health Systems, a Texas-based company that operates dozens of hospitals and clinics in eight different states, as well as against other HFA clients.

The lawsuit was filed in 1998, alleging massive fraud over a decade-plus period extending from 1988 to 2001. The suit alleged that Christus hospitals billed Medicare for their own marketing and advertising costs, as well as for various administrative outlays. Additionally, Christus knew of but did not pass along to Medicare material information concerning accounting errors related to the cost reports.

The government recovered nearly $62.9 million as a result of the case, and Christus recently agreed to pay nearly $1 million to settle the fraud allegations against it. The results of the qui tam lawsuit were not known to the public until a federal judge in Los Angeles recently unsealed the case.
